Richard Bainter is Of Counsel, practicing international law with the firm. He has been practicing law since 1988 as a litigator, public interest advocate, mediator, and as legal counsel to several international organizations. He has worked extensively in the country of Bosnia where he advised clients on their legal relationships with the UN Security Council and other United Nations agencies, the European Union, North Atlantic Treaty Organization (NATO), the Organization for Security and Cooperation in Europe (OSCE) and with several European governments. He also collaborated with Bosnian authorities and with teams of international experts to draft Bosnian legislation, including laws regarding elections, political party financing, conflicts of interest, presidential succession, military defense, and army service.
Mr. Bainter has experience in arbitration and mediation. In 2015, he worked with the European Court of Arbitration to establish special rules for the resolution of international, employment-related disputes. He has extensive knowledge of the Vienna Convention on Diplomatic Relations, the Vienna Convention on the Law on Treaties, the Convention on Privileges and Immunities of the United Nations, the Foreign Sovereign Immunities Act, the International Organizations Immunities Act, the Foreign Agent Registration Act and the law of international civil service.
Mr. Bainter has served as a legal analyst on election missions to Bulgaria, Lithuania, and Poland. He has also observed elections in Azerbaijan, Belarus, and Ukraine. He worked with a team of international attorneys to advise the United Nations on legal issues related to the referendum on the independence of South Sudan and he advised the Vietnam Lawyers’ Association during the drafting of a law on referendum in Vietnam.
Mr. Bainter is widely known in the international legal and diplomacy community. He is the President of the San Diego Diplomacy Council, an organization that facilitates the visits of foreign leaders to San Diego. He has served on the board of directors of Common Cause, a nonprofit organization that promotes open, honest and accountable government in the United States. He has lectured on international law at the University of California, San Diego and the University of San Diego School of Law.
Mr. Bainter is a member of the International Law Section of both the American Bar Association and the State Bar of California. He received his law degree from the University of Denver College of Law and has been licensed to practice law in Colorado since 1988 and in California since 2010.
